The NLRB announced this morning that it will file a Notice of Proposed Rulemaking to “streamline” the NLRB election process, effectively laying the groundwork to shrink election periods from their current 42 day target to something smaller. Dissenting Republican NLRB Member Brian Hayes feared election periods would shrink to 10-21 days. To be clear, this NPRM is not establishing a shortened election period. Instead it proposes steps to reduce or eliminate pre-election litigation about the proper voting unit and reduces the time required for the employer to get its list of eligible voters to the union from 7 days down to 2.
